By accessing or using the FORGE Sports platform at forgesports.io (the "Platform"), operated by S3 Technology LLC ("S3 Technology," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Platform.
If you are a parent or legal guardian registering on behalf of a minor under the age of 18, you accept these Terms on behalf of yourself and the minor. You represent that you have the legal authority to bind the minor to these Terms.
FORGE Sports is a talent evaluation and development platform for youth athletes. The Platform enables coaches and evaluators to assess player performance, and enables players and their families to track development, receive evaluations, and gain exposure to opportunities. The Platform collects and displays player profiles, performance evaluations, video and photos, and related athletic development data.
You must be at least 18 years old to create an account on the Platform. Players under 18 must have their account created or authorized by a parent or legal guardian. Coaches and evaluators must be at least 18 years old.
When creating an account, you agree to provide accurate, current, and complete information, and to update such information as necessary. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
Coaches may invite players and families to join the Platform via email. Acceptance of an invitation constitutes agreement to these Terms.

Access to specific features may vary by subscription tier and role permissions.
The Platform offers multiple subscription tiers with varying levels of access and features. Pricing and tier details are published on the Platform and may be updated from time to time.
Payments are processed through Stripe, Inc. ("Stripe"). By making a payment, you agree to Stripe's terms of service and privacy policy. S3 Technology does not store your full credit card or payment information directly.
Subscription fees are billed in advance on a recurring basis. You may cancel your subscription at any time, but no refunds will be issued for partial billing periods unless otherwise required by applicable law.
"User Content" means any data, text, images, video, evaluations, or other materials you upload, submit, or transmit through the Platform.
You retain ownership of your User Content. By submitting User Content to the Platform, you grant S3 Technology a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute your User Content solely for the purpose of operating, improving, and providing the Platform and its services.
You represent that you have the right to submit all User Content and that your User Content does not violate any third-party rights or applicable law.
FORGE Sports collects and processes data about youth athletes, including minors under the age of 13. We comply with the Children's Online Privacy Protection Act (COPPA) and applicable state privacy laws. Our collection and use of personal information from children under 13 requires verifiable parental consent.

The Platform, including its design, features, code, and branding (including the FORGE Sports name, logo, and related marks), is owned by S3 Technology LLC and protected by intellectual property laws. Nothing in these Terms grants you any right to use S3 Technology's trademarks or branding without prior written consent.
Clubs that partner with FORGE Sports retain ownership of their proprietary data (rosters, internal notes, organizational information). Player evaluation data created on the Platform is owned by S3 Technology LLC, with licensed access provided to the club and the player/family per the terms of the applicable partnership agreement.
Upon termination of a club partnership, clubs may request export of their proprietary data. Player profiles and evaluations remain on the Platform and accessible to the player/family.
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
S3 Technology does not guarantee that the Platform will be uninterrupted, error-free, or secure. S3 Technology does not guarantee any particular outcome related to athletic development, college placement, or professional opportunities.
Evaluations and ratings provided through the Platform represent the opinions of individual evaluators and do not constitute guarantees or endorsements by S3 Technology.
To the fullest extent permitted by law, S3 Technology LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform, whether based on warranty, contract, tort, or any other legal theory.
S3 Technology's total liability to you for any and all claims arising from or related to the Platform shall not exceed the amounts paid by you to S3 Technology in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless S3 Technology LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.
We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to access the Platform ceases immediately.
You may terminate your account at any time by contacting us. Upon termination by either party, we will handle your data in accordance with our Privacy Policy and applicable law.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Platform at least thirty (30) days before the changes take effect. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the modified Terms.
These Terms are governed by and construed in accordance with the laws of the State of Iowa, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Linn County, Iowa.
